This notice explains how personal data is processed when you visit drberkayyuksel.com, contact us through the forms on this website, by phone, e-mail or WhatsApp, or apply for an examination or treatment. It is provided under the Turkish Personal Data Protection Law No. 6698 (“KVKK”) and, for patients in the European Union, the EU General Data Protection Regulation (“GDPR”).

2. Personal Data We Process
- Identity and contact data: name, surname, phone number, e-mail address.
- Appointment and request data: your preferred appointment date and time, the treatment you are interested in, and anything you write in forms or messages.
- Health data (special category data): your complaints and treatment request, photos and documents you choose to send, and medical records created during examination and treatment.
- Technical data: IP address, browser and device information, server access logs.
- Cookie and usage data: data on how the website is used and on advertising performance (only for cookies you allow; see Section 8).
Uploading photos or documents in our forms is optional. Please do not send documents that are not needed for a first assessment.
3. How We Collect Your Data
We collect your data through the appointment and contact forms on this website, phone calls, e-mail, WhatsApp messages, in-person consultations and cookies, by partly automated and non-automated means.

5. Recipients and International Transfers
Within Türkiye: Limited to the purposes above, your data may be shared with public authorities entitled to request it by law (in particular the Ministry of Health), laboratories, hospitals and healthcare providers involved in your treatment, legal and financial advisers, and IT service providers (web hosting, e-mail, software).
Outside Türkiye:
- WhatsApp: If you choose to contact us via WhatsApp, your messages are processed on the servers of WhatsApp (Meta Platforms) outside Türkiye. This transfer takes place at your request so that we can answer you (KVKK Art. 9/6-b). You can also contact us by phone or e-mail instead.
- Google Analytics and Google Ads: Usage data collected by analytics and advertising cookies may be transferred to Google servers outside Türkiye, including the United States. These cookies and the related transfer only take place with your consent, which you can withdraw at any time.
- Hosting and e-mail services: Where the servers of these providers are located abroad, the transfer is carried out in line with the mechanisms set out in KVKK Art. 9.
Transfers from the EU: Türkiye does not have an EU adequacy decision. When you, as a patient in the EU, send us your data in order to receive treatment in Türkiye, the transfer is necessary for the performance of the treatment you have requested (GDPR Art. 49(1)(b)).
Your health data is never shared with third parties for advertising or marketing purposes.
6. Retention
We keep your data for as long as needed for the purpose for which it was collected and for the periods required by law. Examination and treatment records are kept for the periods required by Turkish health legislation. Appointment and information requests that do not lead to treatment are kept for a maximum of 2 years after the request is closed. After that, the data is deleted, destroyed or anonymised.
7. Data Security
This website uses SSL (HTTPS) encryption, access to personal data is limited to authorised persons, and appropriate technical and organisational measures are in place. Patient confidentiality and medical professional secrecy are observed at all times.

9. Your Rights
Under Article 11 of the KVKK you have the right to: learn whether your data is processed and request information about it; learn the purpose of processing and whether data is used accordingly; know the third parties in Türkiye or abroad to whom your data is transferred; request correction of incomplete or inaccurate data; request deletion or destruction under Article 7 of the KVKK; request that such correction, deletion or destruction be notified to third parties to whom the data was transferred; object to a result against you arising exclusively from automated processing; and claim compensation for damage caused by unlawful processing.
If the GDPR applies to you, you also have the right of access, rectification, erasure, restriction of processing, data portability and objection (GDPR Art. 15–21), and the right to lodge a complaint with a data protection supervisory authority, in particular in the EU member state where you live.
Where processing is based on your consent, you can withdraw it at any time. This does not affect the lawfulness of processing carried out before the withdrawal.
10. How to Exercise Your Rights
You can send your request, together with information that allows us to verify your identity:
- in writing to the address above, or
- by e-mail to info@drberkayyuksel.com, from the e-mail address you previously provided to us.
We will answer free of charge as soon as possible and within 30 days at the latest. If the request involves an additional cost, a fee may be charged according to the tariff set by the Turkish Personal Data Protection Board. If your request is rejected, you find the answer insufficient or we do not answer in time, you may file a complaint with the Turkish Personal Data Protection Board.

This notice may be updated in line with changes in the law or in our processing activities. The current version is always published on this page.
